Terms and conditions of sale

E&OEQuotations are valid for 14 days unless stated otherwise

1. Orders and quotations

1.1 An order becomes binding when Nevis Stables Ltd confirms it in writing and receives the required deposit.

1.2 The customer is responsible for checking that all sizes, specifications, colours, layouts and other details shown on the quotation or order confirmation are correct before accepting the order.

1.3 Any alteration requested after the order has been confirmed may result in additional charges and changes to the delivery or installation date.

2. Specifications and materials

2.1 All sizes are nominal and provided for descriptive purposes only.

2.2 Photographs, drawings, brochures and promotional material are provided as a guide. The final goods will be manufactured according to the specification shown on the accepted quotation or order confirmation.

2.3 Timber is a natural material and may shrink, expand, split, crack, twist, warp or change colour due to weather, moisture and temperature. Reasonable natural movement is not considered a manufacturing defect.

2.4 Nevis Stables Ltd may make minor changes to materials, components or construction methods where necessary, provided these do not materially affect the appearance, purpose or performance of the building.

3. Planning permission and site preparation

3.1 The customer is responsible for obtaining any planning permission, licences, consents or other approvals required for the building.

3.2 The customer must ensure that the site and any base or groundworks are completed, level, suitable and ready before the agreed delivery or installation date.

3.3 Unless otherwise agreed in writing, Nevis Stables Ltd is not responsible for checking ground conditions, drainage, underground services, boundaries or planning requirements.

3.4 If the site, base or groundworks are unsuitable or incomplete, installation may be delayed or stopped. Any additional transport, labour, machinery, accommodation or return-visit costs will be charged to the customer.

4. Access and delivery

4.1 The customer must provide safe, suitable and uninterrupted access to the site for our vehicles, trailers, equipment and employees.

4.2 Unless otherwise agreed, suitable vehicle access must be available to within 10 metres of the installation area.

4.3 The customer must inform Nevis Stables Ltd in advance of restricted access, narrow gateways, soft ground, overhead cables, trees, unmade roads, steep slopes or any other obstruction.

4.4 If suitable access is not available, the customer may be required to provide additional labour or machinery, including a tractor, telehandler or trailer, at the customer’s expense.

4.5 Nevis Stables Ltd will take reasonable care when accessing the property but will not be responsible for unavoidable damage to lawns, tracks, paving or other surfaces caused by the reasonable movement of vehicles and equipment.

4.6 Delivery-only orders will be unloaded at the nearest safe and reasonably accessible location.

5. Delivery and installation dates

5.1 Delivery and installation dates are provided in good faith but are estimates unless expressly confirmed as guaranteed in writing.

5.2 Dates may need to be changed because of weather, staffing, transport, material availability, unsafe site conditions or other circumstances outside our reasonable control.

5.3 Nevis Stables Ltd will not be liable for indirect costs or losses caused by a reasonable delivery or installation delay, including costs relating to other contractors.

5.4 If the customer postpones delivery or installation, the order may be moved to the next available date. Storage, transport and other resulting costs may be charged.

5.5 If delivery or installation cannot proceed because of unsuitable access, incomplete groundworks or another issue for which the customer is responsible, the outstanding balance may become due and a further charge will apply for returning to the site.

6. Customer attendance and completion

6.1 The customer, or an authorised representative, must be present upon completion to inspect the building and identify any visible issues.

6.2 If neither the customer nor their representative is present, the work will be treated as inspected and accepted, subject to the customer’s statutory rights.

6.3 Any return visit requested to carry out alterations that were not included in the confirmed order may be charged separately.

7. Payment and ownership

7.1 The deposit stated on the quotation or order confirmation must be paid before manufacturing or ordering materials begins.

7.2 The remaining balance must be paid at the time stated on the quotation or order confirmation.

7.3 The customer must ensure that they, or an authorised representative, are available to make any payment due upon delivery or completion.

7.4 All goods remain the property of Nevis Stables Ltd until all outstanding amounts, including agreed additional charges, have been paid in full.

7.5 Risk of loss or damage passes to the customer once the goods have been delivered to the site. The customer is responsible for arranging suitable insurance from that point.

7.6 Nevis Stables Ltd reserves the right to recover unpaid goods where legally permitted. The customer must not sell, remove or dispose of goods that have not been paid for in full.

7.7 Reasonable recovery costs may be added to overdue accounts where permitted by law.

8. Cancellation

8.1 Cancellation requests must be made in writing.

8.2 If an order is cancelled before manufacturing or purchasing of materials begins, Nevis Stables Ltd may deduct reasonable administration and other costs already incurred before refunding any balance.

8.3 Deposits may be non-refundable once bespoke manufacturing has started or specially ordered materials have been purchased.

8.4 If the customer cancels within five working days of the agreed delivery date, Nevis Stables Ltd may charge up to 50% of the order value, subject to the work completed and costs reasonably incurred.

8.5 If the customer cancels on the delivery or installation date, the full amount may become payable where the goods have been manufactured specifically for the customer and cannot reasonably be resold.

8.6 Nothing in these conditions affects any cancellation rights the customer may have under applicable consumer law.

9. Shortages, damage and complaints

9.1 The customer must notify Nevis Stables Ltd in writing of any visible shortage, damage or complaint as soon as reasonably possible and within seven days of delivery or completion.

9.2 Any shortage, damage or concern must be reported before livestock is admitted or third-party work is undertaken.

9.3 Nevis Stables Ltd must be given a reasonable opportunity to inspect and rectify any fault for which it is responsible.

9.4 Nevis Stables Ltd will not reimburse the cost of repairs or alterations carried out by another contractor unless written approval was obtained beforehand.

9.5 The customer must take reasonable steps to prevent further damage while a reported issue is being investigated.

10. Weather, maintenance and damage

10.1 The customer is responsible for routine maintenance of the building and for following any maintenance guidance supplied by Nevis Stables Ltd.

10.2 Nevis Stables Ltd is not responsible for damage caused by inadequate maintenance, misuse, livestock, accidental impact, unauthorised alterations, fire, theft, flooding, extreme weather or other circumstances outside its reasonable control.

10.3 Used, repaired or ex-display buildings may show reasonable signs of previous use, dismantling, transportation and reassembly.

11. Liability

11.1 Nevis Stables Ltd does not exclude or restrict liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or the customer’s statutory rights.

11.2 Subject to clause 11.1, Nevis Stables Ltd will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the order was accepted.

12. Governing law

12.1 These terms and each order shall be governed by the laws of England and Wales.

12.2 Nothing in these conditions affects the customer’s statutory rights.

By accepting the quotation or paying the deposit, the customer confirms that they have read and accepted these terms and conditions.
